Terms of Service

1. Agreement to these Terms
These Terms of Service (“Terms”) are a binding agreement between you and Supper LLC(“Supper,” “we,” “us,” or “our”) and govern your use of the Supper mobile application and our website at cooksupper.co (together, the “Service”). By creating an account or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old (or 16 in the European Economic Area and the United Kingdom) to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.
3. Your account
You sign in using Sign in with Apple, Google Sign-In, or a one-time code sent to your email. You are responsible for maintaining the security of the account, email inbox, and device you use to access the Service, and for all activity that occurs under your account. Notify us promptly at support@cooksupper.co if you believe your account has been compromised.
4. The Service
Supper helps you discover recipes, plan meals, build grocery lists, and cook. The Service includes features that use artificial intelligence to generate recipe summaries and customizations (such as ingredient substitutions and dietary adaptations) at your request. We may add, change, or remove features at any time.
5. Recipe content, AI features, and food-safety disclaimer
Recipes, nutritional information, ingredient substitutions, dietary adaptations, and other content are provided for general informational purposes only. AI-generated content may be inaccurate or incomplete.
You are responsible for your own food safety. Supper does not verify that any recipe or customization is safe, accurate, or suitable for your health needs. Always check ingredients and finished dishes against your own allergies, dietary restrictions, and medical requirements, and follow safe food-handling and cooking practices. The Service is not a substitute for professional medical, nutritional, or dietary advice. If you have a food allergy or medical condition, consult a qualified professional.
6. Acceptable use
You agree not to:
- Use the Service in violation of any law or these Terms;
- Access the Service using automated means, or scrape, harvest, or bulk-export content except as expressly permitted;
- Interfere with, disrupt, or attempt to gain unauthorized access to the Service, its systems, or other users’ accounts;
- Reverse engineer, decompile, or attempt to extract source code, except where this restriction is prohibited by law;
- Upload or import content that infringes others’ rights or that you do not have the right to use; or
- Use the Service to develop a competing product or to train a machine- learning model.
7. User content
The Service lets you create and import content, including imported recipes, lists, and preferences (“User Content”). You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and process your User Content solely to operate and provide the Service to you. You are responsible for your User Content and represent that you have the rights necessary to provide it.
When you import a recipe from a third-party website, that recipe remains subject to the rights of its original publisher; you are responsible for ensuring your use complies with their terms.
8. Intellectual property
The Service, including its software, design, the Supper name and logo, and all related content (other than User Content and third-party content), is owned by Supper LLC or its licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use. We reserve all rights not expressly granted.
9. Third-party services
The Service relies on and links to third-party services, including Apple, Google, the recipe websites and social posts you choose to import from, and any grocery or checkout service you connect (such as Kroger or Amazon). We are not responsible for third-party services or content, and your use of them may be subject to their own terms and privacy policies.
10. App Store terms
If you download the App from the Apple App Store, you acknowledge that these Terms are between you and Supper LLC only, not Apple, and that Apple is not responsible for the App or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You also agree to comply with the applicable App Store Terms of Service.
11. Fees
The Service is currently provided free of charge. If we introduce paid features in the future, we will present the applicable prices and terms before you incur any charge, and any purchases made through an app store will also be subject to that store’s terms.
12. Termination
You may stop using the Service and delete your account at any time from the App’s settings. We may suspend or terminate your access to the Service if you violate these Terms, if we are required to by law, or if we discontinue the Service. Upon termination, the licenses granted to you end, and the sections of these Terms that by their nature should survive (including Sections 5, 7, 8, and 13 through 16) will survive.
13. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that content (including AI- generated content) will be accurate or reliable. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
14. Limitation of liability
To the maximum extent permitted by law, Supper LLC and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of the Service. To the maximum extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or US $100. Some jurisdictions do not allow these limitations, so they may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless Supper LLCfrom any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your User Content, your use of the Service, or your violation of these Terms or of any law or third-party right.
16. Governing law and disputes
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. You and Supper LLC agree to first try to resolve any dispute informally by contacting us. If a dispute is not resolved, you agree that it will be brought exclusively in the state and federal courts located in California, and you consent to the personal jurisdiction of those courts. Nothing in these Terms limits any rights you may have under the mandatory consumer-protection laws of your place of residence.
17. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, for material changes, provide additional notice through the Service or by email where appropriate. Your continued use of the Service after an update takes effect means you accept the revised Terms.
